The Commission Implementing Regulation 2021/279 of 22 February 2021 has now been published. It lays down detailed rules for the implementation of Regulation (EU) 2018/848 of the European Parliament and of the Council on controls and other measures ensuring traceability and compliance in organic production and the labelling of organic products. This regulation defines, in case of suspicion of a non-compliance due to the presence of a non-permitted substance, the procedural steps to be followed and the relevant documents to be provided when operators proceed to confirm the suspicion according to art. 28 of Reg. (EU) 2018/848 and the elements and results expected from the official investigation conducted by the Control Bodies. With regard to groups of operators, it establishes the maximum size of the groups and the list of documents and records concerning the internal control system. Finally, it establishes minimum percentages of official controls and sampling, and indications for the definition of a common catalogue of measures in case of non-compliance.
